1. Purpose

 

CHAUFFR respects the privacy of its passengers, clients, website visitors, drivers, contractors, suppliers and other individuals.

This Privacy Policy explains how CHAUFFR collects, holds, uses, discloses, secures, accesses and corrects personal information.

CHAUFFR aims to handle personal information consistently with the Privacy Act 1988 (Cth), the Australian Privacy Principles and other applicable laws. Where CHAUFFR is not legally required to comply with a particular privacy obligation, this policy reflects the privacy practices CHAUFFR intends to follow as a matter of good business practice.

 

2. Who We Are

 

CHAUFFR provides chauffeur-driven passenger transport services, including airport transfers, corporate travel, events, cruise transfers, point-to-point transport and group travel.

In this policy, “CHAUFFR”, “we”, “us” and “our” refer to the CHAUFFR business operated under ACN 689 240 471.

3. Scope

 

This policy applies to personal information handled by CHAUFFR through:

  • our website and online booking or quotation forms;

  • telephone, email, SMS and other communications;

  • bookings made directly or through corporate clients, travel agents, affiliates, booking platforms or other partners;

  • the delivery of passenger transport and related services;

  • accounts, payments, invoicing and customer support;

  • driver, contractor, supplier and affiliate onboarding and administration; and

  • marketing, analytics, security, incident management and legal compliance activities.

Third-party websites, booking systems and payment providers may have their own privacy policies. CHAUFFR is not responsible for the privacy practices of a third party where that party independently controls the handling of personal information.

 

4. Personal Information We Collect

 

The types of information collected depend on the person’s dealings with CHAUFFR and the service requested.

We may collect:

  • identity and contact information, including name, title, telephone number, email address, billing address and company details;

  • booking information, including pickup and destination addresses, dates and times, passenger numbers, itinerary details, flight or cruise information, luggage requirements, vehicle preferences and booking history;

  • passenger and service information, including the names of accompanying passengers, meet-and-greet instructions, child-seat requirements, accessibility needs and other reasonable service requests;

  • payment and transaction information, including payment status, invoices, receipts, refunds and limited payment-card details supplied by a payment processor. CHAUFFR does not ordinarily retain complete card security codes;

  • communications, feedback and support records, including emails, messages, telephone notes, complaints, reviews and survey responses;

  • technical and website information, including IP address, browser and device information, pages visited, referral source, cookies and similar technologies;

  • location and journey information generated in connection with a booking, including pickup progress, driver location, route information, timestamps and service completion details;

  • incident and safety information, including reports, photographs, vehicle information, insurance details, witness information and communications with emergency services, police, regulators or insurers;

  • business-contact information for corporate clients, affiliates, travel agents, hotels, suppliers and professional advisers; and

  • workforce information about employees, applicants, contractors and drivers, including identification, licensing, accreditation, work eligibility, qualifications, availability, performance, safety and compliance information.

 

5. Sensitive Information

 

CHAUFFR will only collect sensitive information where it is reasonably necessary for our functions or activities and consent has been provided, or where collection is otherwise permitted by law.

Sensitive information may include limited health, disability or mobility information supplied to arrange an accessible or safe service.

Passengers should only provide information that is relevant to the service. CHAUFFR does not require a detailed medical diagnosis where practical service instructions are sufficient.

 

6. How We Collect Personal Information

 

We generally collect personal information directly from the individual, including when a person:

  • requests a quote or makes, changes or cancels a booking;

  • uses our website, telephone service, email, SMS or social-media channels;

  • travels with CHAUFFR or communicates with a driver or dispatcher;

  • makes a payment, requests an invoice or seeks a refund;

  • submits feedback, a complaint, an enquiry or a job or contractor application; or

  • participates in a promotion, survey or business relationship.

We may also collect personal information from:

  • a person booking on behalf of another passenger;

  • an employer or corporate client;

  • a travel agent;

  • a hotel;

  • an airline or cruise operator;

  • an event organiser;

  • an affiliate transport provider;

  • a booking platform;

  • an insurer;

  • a regulator;

  • a publicly available source; or

  • another person authorised to provide the information.

A person who provides personal information about another individual should ensure they are authorised to do so and, where appropriate, make that individual aware of this policy.

 

7. Anonymity and Pseudonyms

 

Individuals may interact with CHAUFFR anonymously or by using a pseudonym where lawful and practicable.

However, CHAUFFR generally requires accurate identity, contact, booking and payment information to provide passenger transport, meet safety obligations, manage lost property, prevent fraud and respond to incidents.

 

8. Why We Collect, Use and Disclose Information

 

CHAUFFR may collect, use and disclose personal information for purposes including:

  • providing quotations, accepting and managing bookings, allocating vehicles and drivers, and delivering transport services;

  • communicating booking confirmations, driver details, pickup updates, service changes, receipts and customer-support information;

  • processing payments, deposits, fees, refunds, accounts and debt recovery;

  • personalising services and recording reasonable passenger preferences;

  • verifying identity, preventing fraud and protecting passengers, workers, vehicles and the public;

  • managing delays, disruptions, lost property, complaints, incidents, insurance claims and emergencies;

  • maintaining service quality, training workers, monitoring compliance and improving operations;

  • operating, securing and analysing our website, communications and booking systems;

  • managing relationships with corporate clients, affiliates, suppliers, contractors, drivers and professional advisers;

  • meeting legal, regulatory, licensing, accreditation, taxation, insurance, audit and recordkeeping requirements;

  • responding to lawful requests from courts, law-enforcement agencies, regulators and government authorities; and

  • conducting marketing where permitted and with any consent required by law.

We may also use or disclose personal information for a related purpose that an individual would reasonably expect, where authorised or required by law, or with consent.

 

9. Direct Marketing

 

CHAUFFR may send service updates, offers or other marketing communications where permitted by law.

Individuals may opt out at any time by:

  • using the unsubscribe facility in the message; or

  • contacting contact@chauffr.com.au.

Opting out of marketing does not prevent CHAUFFR from sending non-marketing communications necessary to manage a current booking, account, safety matter or legal obligation.

 

10. Disclosure to Third Parties

 

CHAUFFR may disclose personal information to third parties where reasonably necessary, including:

  • CHAUFFR drivers, employees, contractors and authorised representatives;

  • affiliate chauffeur and transport providers where they are required to fulfil or support a booking;

  • booking, dispatch, communications, mapping, navigation, hosting, cloud-storage, analytics and customer-management service providers;

  • banks, payment processors, accounting providers and debt-recovery providers;

  • corporate clients, travel agents, hotels, event organisers or other booking parties, where appropriate to manage the service;

  • insurers, roadside-assistance providers, vehicle suppliers and repairers;

  • professional advisers, including legal, accounting, compliance and information-security advisers;

  • police, emergency services, courts, regulators and government authorities where required or authorised by law; and

  • a purchaser, investor or adviser involved in a proposed or completed sale, restructure or transfer of all or part of the business, subject to appropriate confidentiality arrangements.

CHAUFFR will not sell personal information as a standalone commercial product.

 

11. Corporate and Third-Party Bookings

 

Where a booking is made through an employer, corporate account, travel arranger, affiliate or other third party, CHAUFFR may provide that party with information reasonably necessary to administer the booking.

This may include:

  • the passenger’s name;

  • itinerary;

  • service status;

  • charges;

  • receipts; and

  • incident information.

The booking party may independently handle that information under its own privacy practices.

 

12. Overseas Disclosure and Storage

 

Some technology, communications, payment, booking or cloud-service providers used by CHAUFFR may store or process information outside Australia.

The locations may vary depending on the provider and its infrastructure and may include countries in which our booking or affiliate partners operate.

Where the Australian Privacy Principles apply, CHAUFFR will take reasonable steps required by law in relation to overseas disclosures.

13. Website, Cookies and Analytics

 

Our website may use cookies and similar technologies to:

  • operate site functions;

  • remember preferences;

  • understand website use;

  • improve performance;

  • measure advertising; and

  • help protect against misuse.

Cookies may collect technical information such as:

  • IP address;

  • device type;

  • browser;

  • approximate location; and

  • pages viewed.

Browser settings can be used to block or delete cookies, although some website functions may not operate correctly as a result.

14. Location, Journey and In-Vehicle Information

 

CHAUFFR may use booking, dispatch, navigation and vehicle systems that record:

  • driver location;

  • route information;

  • timestamps; and

  • journey status.

This information may be used to:

  • provide the service;

  • estimate arrival times;

  • coordinate pickups;

  • verify service completion;

  • calculate charges;

  • support safety; and

  • investigate complaints or incidents.

Where dash cameras, vehicle telematics or other recording systems are used, CHAUFFR will handle resulting information for legitimate safety, security, insurance, training or incident-management purposes and in accordance with applicable laws.

Recording practices may vary by vehicle or service provider.

 

15. Security of Personal Information

 

CHAUFFR takes reasonable steps appropriate to the circumstances to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

Measures may include:

  • access controls and password protection;

  • multi-factor authentication where available;

  • secure cloud, booking and payment providers;

  • restricted access based on work responsibilities;

  • staff and contractor confidentiality obligations;

  • device, software and account-management practices;

  • secure disposal or de-identification when information is no longer required; and

  • incident-response and data-breach procedures.

No transmission or storage system is completely secure.

Individuals should avoid sending unnecessary sensitive information through unsecured channels and should notify CHAUFFR promptly if they suspect unauthorised access to their booking or account information.

 

16. Retention and Destruction

 

CHAUFFR retains personal information for as long as reasonably necessary for the purpose for which it was collected, including to:

  • maintain business and safety records;

  • resolve disputes;

  • prevent fraud;

  • enforce agreements; and

  • comply with taxation, insurance, legal and regulatory requirements.

When information is no longer required and CHAUFFR is not legally required to retain it, we will take reasonable steps to destroy it securely or de-identify it.

Retention periods may differ depending on the type of record and the circumstances of a booking or incident.

 

17. Access to Personal Information

 

An individual may request access to personal information CHAUFFR holds about them by emailing contact@chauffr.com.au.

CHAUFFR may ask for:

  • proof of identity; and

  • sufficient details to locate the information.

We will respond within a reasonable period.

Access may be refused or limited where permitted by law, including where access would:

  • unreasonably affect another person’s privacy;

  • reveal commercially sensitive evaluative information;

  • prejudice an investigation or legal proceeding; or

  • otherwise be unlawful.

Where required, CHAUFFR will provide written reasons for refusal and information about available complaint mechanisms.

CHAUFFR will not ordinarily charge for making an access request. A reasonable charge may apply for the cost of providing access where permitted, and the requester will be informed beforehand.

 

18. Correction of Personal Information

 

Individuals may ask CHAUFFR to correct personal information that is:

  • inaccurate;

  • out of date;

  • incomplete;

  • irrelevant; or

  • misleading.

CHAUFFR will take reasonable steps to correct information where appropriate and, where required and practicable, notify relevant third parties to whom incorrect information was previously disclosed.

If CHAUFFR refuses a correction request, we will provide reasons where required and explain available complaint mechanisms.

Please provide enough detail to understand the concern and include relevant dates, booking references and supporting material where available.

CHAUFFR will:

  • acknowledge and investigate the complaint;

  • contact the complainant for further information where required; and

  • provide an outcome within a reasonable timeframe.

Where the Privacy Act applies and a complainant is not satisfied with CHAUFFR’s response, they may be entitled to complain to the Office of the Australian Information Commissioner.

 

20. Data Breaches

 

CHAUFFR maintains processes to identify, contain, assess and respond to suspected data breaches.

Where the Notifiable Data Breaches scheme applies and a breach is likely to result in serious harm, CHAUFFR will notify affected individuals and the Office of the Australian Information Commissioner as required by law.

 

21. Children and Bookings Made for Others

 

CHAUFFR services may transport children when booked and supervised in accordance with applicable requirements.

A parent, guardian or authorised booking party should provide only the information reasonably necessary to arrange the service, including child-seat or supervision requirements.

CHAUFFR does not knowingly use children’s personal information for direct marketing without appropriate authorisation.

 

22. Employee and Contractor Records

 

CHAUFFR may handle personal information about applicants, employees, drivers and contractors for:

  • recruitment;

  • engagement;

  • rostering;

  • payment;

  • safety;

  • licensing;

  • insurance;

  • performance; and

  • compliance purposes.

Some employee records may be subject to specific legal exemptions or workplace laws.

CHAUFFR will nevertheless seek to handle workforce information securely and only for legitimate purposes.

 

23. Changes to This Policy

 

CHAUFFR may update this policy to reflect changes to its:

  • services;

  • systems;

  • legal obligations; or

  • privacy practices.

The current version will be made available through CHAUFFR’s website or on request.

Material changes will apply from the stated effective date.
